CR1 Visa: Conditional Resident Spouse

The CR-1 Visa (Conditional Resident Spouse Visa) allows foreign spouses of U.S. citizens to enter the United States as conditional permanent residents. It is a marriage-based immigrant visa that provides a Green Card upon arrival but requires the couple to apply for removal of conditions after two years to maintain permanent residency.

What is the CR-1 Visa?

The CR-1 (Conditional Resident) Visa is a spouse visa for foreign nationals married to U.S. citizens. It grants the applicant a Green Card with conditional residency for two years. After this period, the couple must apply to remove conditions (Form I-751) to receive a 10-year Green Card.

The CR-1 visa is ideal for couples who have been married for less than two years at visa approval. If the marriage is over two years old, the applicant may qualify for an IR-1 Visa (Immediate Relative Spouse Visa) instead.

CR-1 Visa Eligibility Requirements

To qualify for the CR-1 visa, applicants must meet the following criteria:

  • Legally Married: The marriage must be legally recognized in the country where it took place.
  • U.S. Citizen Sponsor: Only U.S. citizens (not Green Card holders) can sponsor a CR-1 visa.
  • Proof of a Genuine Marriage: Must provide evidence that the marriage is legitimate and not fraudulent.
  • Financial Requirements: The U.S. spouse must meet the minimum income requirement or have a financial co-sponsor.

Required Documents for the CR-1 Visa

  • Form I-130 (Petition for Alien Relative).
  • Marriage certificate and evidence of a bona fide marriage
  • Valid passports for both spouses.
  • Proof of U.S. citizenship (birth, naturalisation, or passport).
  • Affidavit of Support (Form I-864) to prove financial capability.
  • Police clearance certificates from all countries where the foreign spouse lived.
  • Medical examination results from a U.S.-approved doctor.

Processing Time for the CR-1 Visa

  • USCIS I-130 Processing: 8 to 12 months.
  • NVC Processing & Interview Scheduling: 3 to 6 months.
  • Total Time to CR-1 Visa Approval: 12 to 18 months.

File Form I-130 (Petition for Alien Relative)

  • The U.S. citizen spouse must file Form I-130 with USCIS to establish a valid marriage.
  • Include proof of marriage (marriage certificate, joint assets, photos, etc.).

USCIS Approval & NVC Processing

  • If approved, the case moves to the National Visa Center (NVC).
  • The applicant must submit Form DS-260 (Immigrant Visa Application) and the required documents.

Attend Visa Interview at a U.S. Embassy

  • The foreign spouse attends an interview at the U.S. embassy or consulate.
  • If approved, they receive a CR-1 visa stamped in their passport.

Enter the U.S. & Receive Green Card

  • Upon arrival in the U.S., the spouse becomes a conditional permanent resident.
  • A Green Card is mailed within weeks of entry.

Remove Conditions After Two Years

  • Before the two-year expiration, the couple must file Form I-751 (Petition to Remove Conditions on Residence).
  • If approved, the spouse receives a 10-year permanent Green Card.
