O-1A Visa

The O-1A Visa is a non-immigrant work visa for individuals with extraordinary ability in science, education, business, or athletics. It is designed for professionals who have achieved national or international recognition in their field and are coming to the United States to work in their area of expertise.

This visa is initially granted for up to three years, with extensions available in one-year increments as long as the applicant continues to work in their specialized field.

How to Apply for O-1A Visa

• Employer or Agent Files Form I-129 with USCIS: A U.S. employer or agent submits Form I-129 (Petition for a Nonimmigrant Worker) with supporting documents proving the applicant’s extraordinary ability.
• Provide Supporting Evidence: Submit evidence that meets at least three O-1A eligibility criteria, including awards, recognitions, publications, employment contracts, and letters of recommendation from experts in the field.
• Wait for USCIS Approval: If approved, USCIS issues a Form I-797 (Approval Notice).
• Apply for a Visa at a U.S. Embassy or Consulate: Complete Form DS-160 and schedule a visa interview. Bring valid passport, Form I-797 approval notice, evidence of extraordinary ability (awards, publications, etc.), and employment offer letter.
• Enter the U.S. & Begin Work: If approved, the applicant receives an O-1A visa stamp and can enter the U.S. to work in their extraordinary ability field.
